HealAssist is a hospital discovery, comparison, and patient-hospital facilitation platform only. The Platform is designed to help patients discover and compare hospitals and healthcare services available in India. HealAssist is NOT:

• a) A healthcare provider or medical practice;
• b) A medical referral service or medical recommendation service;
• c) A telemedicine platform or telehealth service;
• d) A medical diagnosis or treatment platform;
• e) An emergency medical service;
• f) A substitute for professional medical consultation;
• g) Regulated or licensed as a healthcare provider;
• h) Subject to healthcare licensing requirements (except as a non-medical business platform).

1.2 No Medical Services or Medical Advice

HealAssist DOES NOT AND DOES NOT INTEND TO:

• a) Provide medical advice, diagnosis, or treatment: Any information on the Platform regarding medical conditions, treatments, symptoms, or health matters is general informational content only and NOT medical advice;
• b) Recommend specific hospitals or treatments: Patient-hospital matching is based on non-medical factors (location, cost, facilities) and is NOT a medical recommendation;
• c) Make clinical decisions: All clinical decisions, diagnosis, and treatment planning are exclusively between you and your treating healthcare provider;
• d) Perform medical functions: HealAssist performs zero medical functions and does not practice medicine in any form;
• e) Substitute professional judgment: Platform information never substitutes for consultation with a licensed physician or healthcare professional.

1.3 No Liability for Medical Decisions

You acknowledge and agree that:

• a) Your responsibility: Any medical decision you make based on information from the Platform is entirely your responsibility;
• b) Consult professionals: For any medical concerns, conditions, or health matters, you MUST consult a licensed healthcare professional or physician;
• c) No reliance: You agree NOT to rely on the Platform for medical advice, diagnosis, or treatment decisions;
• d) Self-diagnosis prohibited: Self-diagnosis or self-treatment based on Platform information is dangerous and expressly prohibited;
• e) Professional consultation mandatory: Professional medical consultation is mandatory for any health concerns, medical conditions, or medical decisions.

2. EMERGENCY MEDICAL SITUATIONS

2.1 NOT FOR EMERGENCIES

The HealAssist Platform is NOT suitable for, and SHOULD NOT BE USED FOR, emergency medical situations.

2.2 Emergency Response Required

In the event of any medical emergency:

• a) DO NOT USE THE PLATFORM: Do not attempt to use HealAssist or the Platform for emergency assistance or guidance;
• b) CALL EMERGENCY SERVICES IMMEDIATELY: Dial 112 (Unified Emergency Services) or your local emergency number without delay;
• c) SEEK IMMEDIATE HOSPITAL CARE: Go to the nearest hospital emergency department or trauma center immediately;
• d) CALL AMBULANCE SERVICES: Contact emergency ambulance services in your area (e.g., dial 108 in India for ambulance and medical services);
• e) SEEK IMMEDIATE PROFESSIONAL CARE: Do not delay in seeking immediate professional medical care and treatment.

2.3 Emergency Examples

Medical emergencies include (but are not limited to):

• a) Severe chest pain or difficulty breathing;
• b) Loss of consciousness or severe confusion;
• c) Severe bleeding or trauma;
• d) Sudden severe headache or vision changes;
• e) Difficulty speaking or facial drooping (signs of stroke);
• f) Severe burns or chemical exposure;
• g) Poisoning or toxic exposure;
• h) Severe allergic reactions;
• i) Difficulty breathing or choking;
• j) Any life-threatening situation requiring immediate professional medical attention.

2.4 NO LIABILITY FOR EMERGENCIES

HealAssist SHALL NOT BE LIABLE for:

• a) Any delay in receiving emergency medical care due to reliance on the Platform;
• b) Any adverse medical outcomes or deterioration of medical conditions during emergencies;
• c) Failure or inability to provide emergency assistance;
• d) Inadequacy of emergency response;
• e) Any injury, harm, or death resulting from emergency situations where the Platform was used or relied upon;
• f) Failure to receive timely emergency treatment due to Platform use.

2.5 Acknowledgment of Emergency Risk

You acknowledge and accept that:

• a) Using the Platform during emergencies is extremely dangerous;
• b) Delay in seeking emergency care can result in serious injury or death;
• c) HealAssist cannot and will not provide emergency assistance;
• d) You assume all risk associated with any reliance on the Platform during emergencies.

3. HOSPITAL AND HEALTHCARE PROVIDER DISCLAIMERS

3.1 Hospital Independence

All hospitals, healthcare providers, and medical institutions listed on the Platform are independent entities. HealAssist:

• a) Does NOT control, own, manage, or operate any hospitals or healthcare providers;
• b) Does NOT employ or supervise hospital staff or healthcare professionals;
• c) Does NOT perform quality assurance or credentialing for hospitals;
• d) Does NOT verify hospital credentials, qualifications, or professional licenses;
• e) Does NOT inspect hospital facilities, equipment, or procedures.

3.2 Hospital Liability

HealAssist is NOT liable for any act, omission, conduct, or decision of hospitals or healthcare providers. Each hospital is solely responsible for:

• a) Medical Services: The quality, appropriateness, safety, and legality of medical services provided;
• b) Professional Standards: Compliance with professional standards, regulations, and ethical requirements;
• c) Staff Competence: Staff qualifications, certifications, competence, and licensing;
• d) Patient Safety: Ensuring patient safety, preventing infections, and managing medical emergencies;
• e) Informed Consent: Obtaining proper informed consent from patients for procedures and treatments;
• f) Confidentiality: Maintaining patient confidentiality and privacy of medical information;
• g) Informed Medical Decisions: Providing accurate information and proper guidance for informed medical decision-making;
• h) Treatment Outcomes: Medical outcomes, complications, and results of treatment provided.

3.3 Hospital Conduct and Negligence

HealAssist is NOT liable for any hospital conduct, negligence, malpractice, or violations of professional standards, including:

• a) Medical negligence or malpractice;
• b) Inappropriate diagnosis or treatment;
• c) Surgical errors or complications;
• d) Hospital-acquired infections;
• e) Medication errors or adverse drug reactions;
• f) Failure to diagnose or misdiagnosis;
• g) Breach of patient privacy or confidentiality;
• h) Unauthorized procedures or treatments;
• i) Breach of patient rights;
• j) Fraud or deceptive practices by hospitals;
• k) Violations of medical ethics or professional standards;
• l) Regulatory violations or licensing issues.

3.4 Hospital Selection is Your Decision

You acknowledge and agree that:

• a) Your choice: Selecting a hospital is entirely your personal decision;
• b) No recommendation: HealAssist's listing of a hospital does NOT constitute a recommendation, endorsement, or guarantee regarding quality, safety, or appropriateness;
• c) Independent verification: You MUST independently verify hospital credentials, services, pricing, doctor qualifications, certifications, and reputation;
• d) Direct communication: You SHOULD communicate directly with hospitals to clarify services, expectations, and costs before engaging;
• e) Due diligence: You MUST conduct thorough due diligence on hospitals before selecting and engaging with them;
• f) Assumption of risk: By selecting and engaging with a hospital through the Platform, you assume all associated risks.

3.5 No Quality Guarantee

HealAssist makes NO warranty or guarantee regarding:

• a) Hospital safety or accreditation;
• b) Hospital cleanliness or hygiene standards;
• c) Hospital staff qualifications or competence;
• d) Hospital compliance with medical standards or regulations;
• e) Hospital service quality or patient experience;
• f) Hospital treatment outcomes or effectiveness;
• g) Hospital pricing accuracy or fairness;
• h) Hospital information accuracy or completeness.

3.6 Hospital Information Accuracy

Hospital information displayed on the Platform (services, pricing, facilities, doctor details, availability):

• a) Hospital responsibility: Is the sole responsibility of the hospital;
• b) Not verified: Is NOT independently verified by HealAssist;
• c) May be inaccurate: May be inaccurate, incomplete, outdated, or misleading;
• d) Subject to change: Is subject to change without notice;
• e) Your verification: You MUST independently verify all hospital information through direct contact with the hospital before reliance.

3.7 Release from Hospital Liability

By using HealAssist and engaging with any hospital through the Platform, you:

• a) Release HealAssist from any liability, claims, or damages arising from hospital conduct, services, or decisions;
• b) Acknowledge hospital independence and accept that hospitals are independent entities;
• c) Accept hospital responsibility that hospitals alone are responsible for their conduct and services;
• d) Waive claims against HealAssist related to hospital conduct, medical outcomes, or healthcare delivery.

4. INFORMATION AND DATA ACCURACY DISCLAIMERS

4.1 General Accuracy Disclaimer

HealAssist makes NO warranty or representation regarding the accuracy, completeness, timeliness, relevance, or reliability of ANY information on the Platform, including:

• a) Hospital information and services;
• b) Hospital pricing and cost estimates;
• c) Hospital facilities and equipment;
• d) Doctor names, qualifications, and certifications;
• e) Hospital availability and appointment scheduling;
• f) Medical information or health content;
• g) Comparison data or analytics;
• h) User-generated content or reviews;
• i) Third-party information or data sources;
• j) Any other information displayed or accessible on the Platform.

4.2 "AS IS" Disclaimer

The Platform and all information are provided "AS IS" and "AS AVAILABLE" without any warranties, guarantees, or representations, whether express or implied, including:

4.4 Self-Declared Information

All personal information you provide to HealAssist is self-declared information. HealAssist:

• a) Does NOT verify your name, age, identity, insurance information, or any other personal data;
• b) Does NOT perform background checks or identity verification;
• c) Does NOT validate the accuracy of information you provide;
• d) Is NOT liable for consequences of inaccurate or false information you provide;
• e) Assumes NO responsibility if hospitals or third parties rely on inaccurate information from you.

You acknowledge that you are solely responsible for the accuracy and validity of all information you provide.

5. SERVICE AVAILABILITY AND TECHNICAL DISCLAIMERS

5.1 No Guarantee of Availability

HealAssist does NOT guarantee continuous, uninterrupted, or error-free access to the Platform. The Platform may experience:

• a) Scheduled Maintenance: Planned maintenance, software updates, system upgrades, or improvements (may be conducted with or without advance notice);
• b) Unscheduled Downtime: Unplanned system failures, technical issues, bugs, or glitches;
• c) Internet Issues: Internet connectivity problems, network disruptions, or bandwidth limitations (which may be beyond HealAssist's control);
• d) Performance Issues: Slow performance, latency, delays, or reduced functionality;
• e) Partial Outages: Limited access to certain features or functionalities;
• f) Complete Discontinuation: Complete discontinuation of services or platform shutdown;
• g) Data Loss: Loss, corruption, or unavailability of data;
• h) Device Incompatibility: Incompatibility with certain devices, browsers, or operating systems.

5.2 No Liability for Service Interruptions

HealAssist is NOT liable for any downtime, service interruption, loss of access, failure to access services, or any damage or loss resulting from:

• c) Third-party provider failures or outages;
• d) Internet connectivity issues or network disruptions;
• e) Device or software incompatibility;

All intellectual property in the Platform, including trademarks, logos, design, code, algorithms, content, databases, and features, is owned by HealAssist. Content from third parties (including user-generated reviews, hospital information, or third-party services) is provided "AS IS" without warranties or representation regarding accuracy, appropriateness, or legality. HealAssist is NOT liable for third-party content.

7. USER CONDUCT AND PROHIBITED ACTIVITIES

7.1 Prohibited Activities

You are strictly prohibited from:

• a) Scraping or extracting data using automated tools or manual methods;
• b) Reverse engineering or hacking the Platform;
• c) Transmitting malware or harmful code;
• d) Spam or harassment of users or hospital staff;
• e) Fraudulent activities or misrepresentation;
• f) Illegal activities or violations of law;
• g) Unauthorized access to systems or accounts;
• h) Any other conduct that violates these Terms or applicable law.

7.2 Liability for Prohibited Activities

By engaging in prohibited activities, you accept full liability for any legal consequences, damages, or losses resulting from such conduct.

8. PAYMENT AND FINANCIAL DISCLAIMERS

HealAssist is NOT a financial services provider. The Platform does:

• a) NOT process payments for hospital services on behalf of users;
• b) NOT handle financial transactions between users and hospitals;
• c) NOT guarantee payment processing or security;

• e) NOT provide financial advice.

8.2 Direct Payment Model

All payments for hospital services are made directly between users and hospitals, not through HealAssist. HealAssist:

• a) Is NOT a party to payment transactions;
• b) Is NOT liable for payment disputes or failures;
• c) Does NOT guarantee successful payment processing;
• d) Does NOT refund payments made directly to hospitals.

8.3 No Refund Guarantee

NO REFUNDS are provided for:

• a) Hospital services rendered;
• b) Medical treatments commenced or completed;
• c) Any healthcare services;
• d) Any reason whatsoever after treatment has commenced.

Hospital refund policies are governed by agreements between users and hospitals, not by HealAssist.

8.4 Financial Disclaimers

HealAssist assumes NO liability for payment fraud, payment processing failures, payment disputes, financial loss, chargebacks, or identity theft.

9. PRIVACY AND DATA SECURITY DISCLAIMERS

• f) Data loss: Loss or corruption of data;
• g) Business disruption: Loss of business opportunity or revenue;

• e) Death or serious injury from medical treatment;
• f) Emotional distress or psychological injury from medical experiences;
• g) Long-term disability or chronic conditions from hospital care;
• h) Any medical harm whatsoever.

12.3 Waiver and Release

By using the Platform and engaging with hospitals through the Platform, you irrevocably waive and release HealAssist from any claims, damages, or liability related to your Platform use or hospital engagement.

DISCLAIMER OF ALL WARRANTIES: Except as expressly stated in the Terms of Use, the Platform and services are provided "AS IS" and "AS AVAILABLE" without any warranties, guarantees, or representations of any kind, whether express or implied, including:

• a) Fitness and Merchantability: Implied warranties of merchantability, fitness for a particular purpose, or suitability for any specific use;
• b) Accuracy: Any warranty regarding accuracy, completeness, currency, or relevance of information;
• c) Non-infringement: Any warranty regarding absence of intellectual property infringement;
• d) Reliability: Any warranty regarding reliability, stability, or performance;
• e) Availability: Any warranty regarding continuous, uninterrupted availability;

14. ACKNOWLEDGMENT OF DISCLAIMERS

14.1 Your Agreement

By accessing and using the HealAssist Platform, you:

• a) Acknowledge that you have read and understood this Disclaimer;
• b) Accept all disclaimers, limitations, and risk acknowledgments;
• c) Agree that you are using the Platform at your own risk;
